Sources of law. In the United States, the law is derived from five sources: constitutional law, statutory law, treaties, administrative regulations, and the common law (which includes case law). Constitutionality. Where Congress enacts a statute that conflicts with the Constitution, state or federal courts may rule that law to be unconstitutional and declare it invalid. courts continued to apply the same rules of decision that had been utilized prior to independence, thus engrafting the English common law upon our American Law. From that time on, courts in each state developed the common law in response to the usages and customs prevailing in their state. While all of the courts started out with the basic English.

As Professor Chad Oldfather explains in a new article, “The Inconspicuous DHS: The Supreme Court, Celebrity Culture, and David H. Souter,” we are unlikely to see anyone like Souter ascend to the highest court in the land again.   Patrons may now enter the State Law Library by appointment. Appointments are available Monday-Friday, am and pm. Patrons can use the library's computers to access XChange, OCAP and forms on the court's website, as well as our print collection (briefs, superseded Utah code, and other materials), and use the library's copier and scanner.

By showing how law and politics interact in the construction of American law, this book sheds new light on the unique role that the Supreme Court plays in the constitutional order. Court authorization, most often for law enforcement officers, to conduct a search or make an arrest. Witness. A person called upon by either side in a lawsuit to give testimony before the court or jury. Writ. A written court order directing a person to take, or refrain from taking, a certain act.
